1. Acceptance of Terms

Welcome to Capital Quiz ("the App"). By downloading, installing, or using the App, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

These Terms constitute a legal agreement between you and Volodymyr Shyrochuk ("Developer", "we", "us", or "our").

2. Description of Service

Capital Quiz is a mobile application that provides:

• Educational quizzes about world capitals and geography
• Achievement and progress tracking
• Daily challenges and streak features
• Leaderboards via Game Center (iOS) and Google Play Games (Android)
• Multiple game modes for varied gameplay experiences
• Support for 60 languages

3. User Eligibility

The App is designed for users of all ages. If you are under 18 years old, you should review these Terms with a parent or guardian to ensure they understand and agree to these Terms.

4. License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

• Download and install the App on your personal mobile device
• Use the App for personal, non-commercial purposes

This license does not allow you to:

• Modify, reverse engineer, or decompile the App
• Copy, distribute, or sell the App or its content
• Use the App for any illegal or unauthorized purpose
• Remove any copyright or proprietary notices

5. User Conduct

When using the App, you agree to:

• Use the App in compliance with all applicable laws and regulations
• Not attempt to gain unauthorized access to the App or its systems
• Not use cheats, exploits, or automation software
• Not interfere with other users' enjoyment of the App
• Not submit false information to leaderboards

6. In-App Purchases

6.1 Premium Features

The App offers optional in-app purchases including:

• Ad-free experience
• Additional game features and content

6.2 Payment and Billing

All purchases are processed through the Apple App Store or Google Play Store. You agree to:

• Pay all charges incurred through your account
• Provide valid payment information
• Be responsible for any taxes associated with purchases

6.3 Refunds

Refund policies are governed by the respective app stores:

• iOS: Contact Apple Support for refund requests
• Android: Contact Google Play Support for refund requests

7. Intellectual Property

7.1 Our Content

The App and its original content, features, and functionality are owned by the Developer and are protected by international copyright, trademark, and other intellectual property laws.

7.2 Geographic Data

Capital city names and geographic information used in the App are factual data presented for educational purposes.

7.3 Third-Party Content

The App may contain links to or integrate with third-party services (Game Center, Google Play Games). These services are governed by their own terms and privacy policies.

8. Disclaimers

8.1 "As Is" Provision

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Implied warranties of merchantability
• Fitness for a particular purpose
• Non-infringement
• Accuracy or completeness of content

8.2 Educational Purpose

While we strive for accuracy, the App is designed for entertainment and educational purposes. We do not guarantee that all quiz content is completely accurate or up-to-date.

8.3 Service Availability

We do not guarantee that the App will be available at all times. The App may be temporarily unavailable due to:

• Maintenance or updates
• Technical issues
• Circumstances beyond our control

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• The Developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages
• The Developer's total liability shall not exceed the amount you paid for the App (if any) in the 12 months preceding the claim
• The Developer is not liable for any loss of data or progress due to device issues, app updates, or cloud sync failures

10. Game Center and Play Games

If you choose to use Game Center (iOS) or Google Play Games (Android):

• You agree to abide by Apple's and Google's respective terms of service
• Leaderboard rankings are provided "as is" and may be affected by service availability
• We are not responsible for issues arising from third-party gaming services

11. Advertisements

The free version of the App displays advertisements. By using the free version, you agree to:

• View advertisements as part of the App experience
• The collection of limited data for ad personalization (see Privacy Policy)

You may remove advertisements by purchasing the premium version.

12. Termination

We may terminate or suspend your access to the App immediately, without prior notice, for any reason, including:

• Violation of these Terms
• Fraudulent or illegal activity
• Behavior that harms other users or our services

Upon termination, your right to use the App will cease immediately.

13. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective when posted. Your continued use of the App after changes constitutes acceptance of the new Terms.

We will notify you of significant changes through:

• App update notes
• In-app notifications
• Updates to this page

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Ukraine, without regard to its conflict of law provisions.

Any disputes arising from these Terms shall be resolved through good faith negotiation. If negotiation fails, disputes shall be submitted to the competent courts of Ukraine.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and the Developer regarding your use of the App.
